HENDRICKSON VS AMAZON GOES TO TRIAL

It has been ORDERED (May 9, 2003) by United States District
Court Judge Terry J. Hatter Jr. that Amazon.com has Directly and
Vicariously infringed upon Robert Hendrickson's copyright in
connection with the unlawful sale of MANSON DVDs on the Amazon.com
website. The matter of "damages" will now go to a Jury to determine if
the infringements were "willful" (conducted with knowledge that the
sale of MANSON DVDs was unauthorized), thus warranting the maximum in
"statutory damages" to be awarded Hendrickson.
Where the US Supreme Court has recently made some very profound
decisions regarding the understanding of US laws and our highly valued
judicial system, the Amazon Jury will consider the Highest Court's
most recent decision upholding the fifty (50) year prison sentence of
Mr. Leandro Andrade for his shoplifting $153.54 (retail value) worth
of "copyrighted materials" (video cassettes) from a Kmart store.
Because Amazon.com continues to infringe upon the MANSON
copyright, Hendrickson has plead to the Court:
"The Court must consider the "deterrence factor" and how the
contemplated "statutory damage" award will actually effect a huge
corporation or even a chain of 25 retail outlets. Obviously, 50 years
in jail or even 30 days in jail to a corporate executive would put a
sure end to AMAZON's arrogant unlawful behavior, but such a deterrence
is only designed for folks of lesser means. Congress did however
provide the Courts with the discretion to award the "maximum" in
statutory damages and especially in "willful" infringement cases, such
as this."
"In this case, where AMAZON escaped liability from its
participation in the "Martin Scriven" infringing activity, and is now
entitled to retain any and all of the unjust profits that it received
as a result of such infringement, to now allow AMAZON to escape the
full measure of "statutory damages" might very well be considered a
travesty of justice."
"Though our founding fathers purposefully invented a duel system
of justice, it was surely never intended to be simply an escape hatch
for the rich and a ball-an-chain for the less fortunate."
"Without question, because the infringement at issue was
conducted "willfully," the deterrence factor, or motivation for AMAZON
to curtail its unlawful operations hinges significantly upon the
amount of this Court's monetary award to Plaintiff, and the subject
May 23, 2002 infringement being a "3 strikes" plus offense for AMAZON,
makes $150,000 pale by comparison to Leandro Andrade's fifty (50) year
life sentence."
"Of course, Civil law established primarily for those of
fortunate means, in the event that they get caught facilitating
elaborate schemes, will never force the privileged few to endure the
strong odor of an unclean jail cell, but will only cause a slight
financial inconvenience to be put upon them,"
PLEASE CONSIDER
Where the Supreme Court just struck down California's law to
extend the statute of limitations, in order to round-up a herd of
dangerous "child molesting" priests, it upheld California's "3
strikes" law, in order to keep Mr. Andrade incarcerated for the next
50 years, though he never posed a violent threat to anyone.
Where the Supreme Court just decided that a multi-million dollar
jury award to an elderly couple, for being defrauded by a huge
insurance company was excessive, the same court decided that Mr.
Andrade'e 50 year sentence was NOT "grossly disproportionate" to the
crime of shoplifting $153.54 worth of video tapes.
The message is clear, intellectual property, belonging to a
copyright owner, is to be given the same value as a piece of tangible
property owned by anyone. America is what it is today, only because of
its protections of inventions and creative works. It doesn't take a
rocket scientist to realize that without someone creating
copyrightable materials, there would be no internet worth logging
onto. There would be only eBay selling whatever.
When three collage students are caught being directly involved
in internet piracy, you have to ask, what the hell are they teaching
in college? Law? AND the concept of "if I don't get caught, it’s OK"
has been around since the birth of the first criminal mind.
